What Is DACA?
Deferred Action for Childhood Arrivals (DACA) was established to protect immigrants from deportation who were brought to the United States as undocumented children. DACA gives eligible undocumented immigrants: protection from deportation, and a work permit. The program expires after two years, subject to renewal. The U.S. Citizenship and Immigration Services (USCIS) is accepting renewal DACA applications. Steps to renew DACA.
As of July 16, 2021, Texas federal court Judge Hanen published his opinion on the DACA case, which challenged the legality of the DACA program. Judge Hanen’s opinion is that DACA is not a lawful program, but for now will allow those with existing DACA to continue to renew. No initial applications will be granted at this time. DACA (Acción Diferida para los Llegados en la infancia): una política establecida para proteger a los inmigrantes de la deportación quienes ingresaron ilegalmente a los Estados Unidos cuando eran niños. What Are The Requirements For DACA?
- You were under 31 years old as of June 15, 2012
- You first came to the United States before your 16th birthday;
- You have lived continuously in the United States from June 15, 2007 until the present;
- You were physically present in the United States on June 15, 2012 and at the time you apply;
- You came to the United States without documents before June 15, 2012, or your lawful status expired as of June 15, 2012;
- You are currently studying, or you graduated from high school or earned a certificate of completion of high school or GED, or have been honorably discharged from the Coast Guard or military (technical and trade school completion also qualifies); and
- You have NOT been convicted of a felony, certain significant misdemeanors (including a single DUI), or three or more misdemeanors of any kind.
- Consult with Jewish Family Service Higher Education Legal Services about ANY contact you have had with law enforcement or immigration authorities.
¿Cuáles son los requisitos para aplicar para el DACA?
- Ingresó ilegalmente a los Estados Unidos antes de cumplir 16 años.
- Ha vivido continuamente en los Estados Unidos desde el 15 de junio de 2007.
